What is the scope of the EU GPSR?
It applies to products placed or made available on the European market — new, used, repaired or reconditioned — and covers every product intended for, or reasonably foreseeable to be used by, consumers, whether or not it is interconnected to other items.
When does the EU GPSR come into force?
The Regulation replaces the General Product Safety Directive (GPSD) 2001/95/EC after a transitional period ending December 13, 2024.
Are any products specifically exempted?
Yes — medicinal products, food, feed, living plants and animals (and GMOs in contained use), animal by-products, plant protection products, equipment operated by a service provider during a transport service, certain aircraft used by public authorities, and antiques are out of scope.
What does "electronic address" mean under Article 9(6)?
An electronic address is any contact channel that allows direct communication with the manufacturer — for example an email address or a website with a contact template. A purely static website is not enough.
Does the electronic address apply to products covered by sector-specific safety law (e.g. toys)?
The physical labelling obligations of Section 1 of Chapter 3 do not apply to products subject to Union harmonisation legislation listed in Annex I of (EU) 2019/1020 — for example toys, aerosols, batteries, cosmetics and electrical equipment.
Can labelling be provided via digital means only?
A digital label can complement the physical one but cannot replace it. Information must be on the product or, where unfeasible, on the packaging — following the Blue Guide on the implementation of EU product rules.
Do labelling obligations apply to distance sales and online marketplaces?
Yes. Where a product is offered under Article 19 (distance sales) or Article 22 (online marketplaces), the labelling — including the electronic address — must appear in the product offer for ALL products, including those covered by Union harmonisation legislation.
Can a manufacturer simply sign a declaration that the product complies?
No. Article 9 requires the manufacturer to conduct an internal risk analysis. A signed declaration is not equivalent. The risk analysis is the responsibility of the manufacturer or their authorised representative.
Does the technical documentation requirement apply to products already on the market?
The technical documentation requirement applies to products first made available on the EU market on or after the GPSR's date of application.
